Allegations
On 24 January 2025, the Stop JCB Demolitions Campaign filed a complaint against J. C. Bamford Excavators Limited (“JCB”) at the UK NCP. The complaint concerns the use of JCB’s heavy machinery in the demolition of Muslim-owned property in India.
The complainant alleges that bulldozers manufactured and sold by JCB’s Indian subsidiary JCB Industries Private Limited have been widely used in demolitions of property owned by religious minorities, especially Muslims, in India. The complainant alleges the demolitions are carried out without due process and in a discriminatory manner and are punitive in nature. The complainant states that JCB is not meeting its human rights responsibilities under the Guidelines by failing to prevent or mitigate human rights harms that are directly linked to the sale of its machinery and by failing to carry out appropriate human rights due diligence.
The complainant is seeking mediation from the NCP to help ensure JCB’s compliance with the Guidelines, including by using leverage with its business partners to prevent use of its machinery in demolitions, carrying out human rights due diligence in relation to its operations and monitoring the due diligence process of its suppliers and dealers.
