25 recommendations to improve impact and increase alignment with the OECD Guidelines
National Action Plans for Business and Human Rights (NAPs) have the potential to establish meaningful and binding commitments on both states and businesses to address harm from business activity and ensure access to remedy. But in practice, NAPs have regularly failed to live up to that potential, criticised for reasons related to their inadequate preparation, unambitious design, and weak implementation.
Drawn from the experience of civil society experts around the world, this report offers 25 recommendations to resolve the core problems common at these three stages of NAP formation. The report also highlights a less-explored nexus between NAPs and the OECD Guidelines and National Contact Point (NCP) complaint mechanisms, highlighting recommendations for improving alignment with the Guidelines and synergy and support with the OECD’s responsible business conduct framework.
We hope our recommendations will be useful for civil society participating in NAP formation, governments undertaking NAPs, and other policymakers and donors that design and fund the creation of NAPs.
